PARTIES: These terms and conditions are between the Unreal Film Festival (hereafter referred to as “the festival”) and the 
submitting parties (hereafter referred to as “the applicant.”) These terms and conditions are in regards to the submission process 
in where the applicant submits their film(s) for consideration to the festival as well as release of rights from the applicant to the 
festival to screen the film(s) submitted by the applicant if they are selected by the festival.
In consideration, the above parties agree to the following:
ELIGIBILITY:
1) To be eligible for submission into the “short film” category, the film must have a projected running time of less than 35 minutes 
with no minimum time requirement.
2) To be eligible for submission into the “feature film” category, the film must have a projected running time of over 75 minutes with 
no maximum time limit.
3a) Films submitted to the festival must not be, or have ever been, available for wide release in the United States. This includes 
any and all video-on-demand or streaming service, DVD/bluray/digital sales, wide theatrical release, and/or televised broadcast 
available in the United States. If any film is released to the wide market between submission to the festival and its screening at the 
festival (if selected), the film is disqualified at the discretion of the festival with no refund on the submission fee.
3b) If a film has been previously released to a wide audience as described in section 3a, a film may be eligible for submission if the 
submitted version is significantly different than the previous version available for wide release. Significant difference is determined 
by the festival judges on a case-by-case basis.
4) Films completed prior to September 23rd, 2017 are not eligible for submissions.
5) Films submitted that contain significant non-English spoken dialogue must provide on-screen English subtitles. The festival 
reserves the right to disqualify, without refund of submission fees, any film that contains significant non-English spoken dialogue 
that does not include accompanying on-screen English subtitles.
6a) Films must be submitted via a screener hosted on a secured streaming service such as Vimeo or YouTube. If a passcode is 
required to view the applicant’s screener, the passcode must be provided.
6a i.) In the event that the applicant remits an updated version of the film to the festival after having submitted a previous version 
of the film to the festival during the same calendar year, the festival is under no obligation to view any or all of the updated version.
6b) If the film maker would rather send a physical copy of the film, DVD, Blu-ray, or USB storage may be submitted directly to the 
festival. Shipping address will be provided upon completion of the submission form.
6b i.) It is the sole responsibility of the applicant to ensure that the submitted physical media, if on a DVD or Blu-ray, is playable in 
its entirety on an industry-standard DVD player prior to submitting it to the festival. In the event that a submitted disc does not play 
on an industry-standard  DVD or Blu-ray player, the festival will attempt, but is under no obligation, to contact the applicant using 
the information provided on the submission form in an effort to obtain a replacement copy of the film. The festival reserves the 
right to disqualify, without refund of submission fees previously collected from the applicant, any film whose initially submitted disc 
does not play on an industry-standard DVD or blue ray player.
       
6b ii.) DVD and Blu-ray submissions should be formatted for Region 0 (worldwide) or Region 1 (U.S./Canada) players. USB 
storage has no formatting restrictions or required file type for the submission, but the files contained on the USB storage must be 
formatted for home use (no DCPs for screeners).
6b iii.) It is the sole responsibility of the applicant to ensure that physically submitted media arrives at the shipping destination 
provided to the applicant upon completion of the submission form. In the event that a submitted physical media does not arrive at 
the provided shipping destination within the deadline window selected by the applicant or the physical media is damaged or some 
otherwise defective, the festival will attempt, but is under no obligation, to contact the applicant using the contact information 
provided on the submission form in an effort to obtain a submission copy of the film. The festival reserves the right to disqualify at 
its own discretion, without refund of any or all submission fees previously collected from the applicant, any film that does not arrive 
at the provided shipping destination within the deadline window selected by the applicant.
       
6b iv.) If the applicant desires to have the physically submitted media returned to them, it is the sole responsibility of the applicant 
to make arrangements to do so, including but not limited to paying any and all shipping costs. The festival is not responsible for 
any damages or losses suffered during return shipment, nor is the festival responsible for the submitted media does not arrive to 
the provided shipping destination.
7) In order to be considered for the festival, the applicant must fill out the submission form located at http://www.withoutabox.com or 
the submission form for direct submission on the www.unrealfilmfest.com website. The festival reserves the right to disqualify, 
without refund of any or all submission fees previously collected from the applicant, any film that is not submitted through one of 
these channels.
SELECTION PROCESS:
1) If, based on the rules and eligibility requirements set forth above in the section labeled “Eligibility,” the film submitted by the 
applicant is eligible for consideration by the festival, the film will be viewed in its entirety by one or more members of our selection 
committee and given the same initial level of consideration as all other films submitted to the Festival.
2) Upon completion of the festival selection process, the festival will attempt to contact the applicant using the contact information 
provided on the submission form to notify the applicant of the film’s acceptance status. The festival will not be held responsible for 
the failure to contact the applicant using the contact information provided on the submission form. It is the sole responsibility of the 
applicant to ensure that the contact information provided on the submission form is correct throughout the entirety of the 
submission period.
3) The festival is under no obligation to provide comments or feedback regarding the submitted film to the applicant or any other 
representative of the submitted film. The festival will not be held responsible or liable for the contents of any internal comments or 
feedback regarding any submitted film obtained by the applicant or any other representative of the submitted film.
4) If accepted into the festival, applicants will be notified to send two screening copies of the finished film to the festival for 
screening purposes. Digital files will only need to be sent once. Applicants who do not submit screening copies of their film by one 
month prior to the festival will be disqualified at the discretion of the festival. The festival is under no obligation to refund partially 
or in-full any entry fees into the festival.
In consideration, the above parties agree to the following:
GRANTS:
If the applicant’s film is selected for the festival, the applicant agrees to the following:
1) The applicant grants the right to the festival to screen the applicant’s film in its entirety during the Unreal Film Festival.
2) The applicant also grants the right to the festival to use stills, clips, posters, and trailers from the applicant’s film in order to 
promote the festival.
3) The applicant grants the right to the festival to screen the applicant’s film in its entirety up to two (2) additional times during 
promotional events for the festival, up until the date of the 2019 Unreal Film Festival.
INDEMNITY:
1) The applicant agrees that the rights granted in the section labeled “Grants” are theirs to give, that the work they are submitting 
is an original work, and that no material contained within the film(s) submitted is intellectual property owned by another entity that 
the applicant does not have permission to use.
2) It is the sole responsibility of the applicant to secure clearance from the copyright holders of any copyrighted materials included 
within the submitted film. The festival will not be held responsible for the unauthorized inclusion of any copyrighted materials within 
or relating to the submitted film. The festival reserves the right to disqualify, without refund of any or all submission fees previously 
collected from the applicant, any film with any unauthorized inclusion of copyrighted materials.
3) The applicant agrees that their work does not intentionally defame any individual or group, nor does it infringe on any person’s 
personality rights, nor does it invade any person’s right to privacy.
4) If anything within the film(s) submitted by the applicant is found to infringe upon these agreements listed in the above three 
sections, then the festival is free from any and all liability and any and all liability is entirely the applicant’s.
ESCAPE:
For the rights granted above in the section labeled “Grants:”
1) If for whatever reason the applicant wishes to withdraw their film from consideration from the festival, they may do so at any time 
by contacting the submissions manager up until the announcement of the films selected for the festival. Any submission fees, 
partial or in full, collected by the festival will not be refunded. All rights granted in the section labeled “Grants” will be nulled.
2) If, at any time up until the scheduled time to screen the applicant’s film, the festival discovers that the applicant’s film does not 
meet the stipulations named in the section labeled “Eligibility,” the festival may disqualify the film and reject it from the festival. Any 
submission fees collected, in part or in full, will not be refunded.
3) The festival reserves the right to disqualify, without refund of any or all submission fees previously collected from the applicant, 
any film with a submission form that is considered to be delinquent due to the non-payment of any or all submission fees. The 
festival will attempt, but is under no obligation, to contact the applicant using the contact information provided on the submission 
form in an effort to bring the payment status of the account up-to-date.
4) As described in section 2 of the section labeled “Indemnity,” the festival reserves the right to disqualify, without refund of any or 
all submission fees previously collected from the applicant, any film with any unauthorized inclusion of copyrighted materials.
STATE OF EXECUTION:
1) This contract shall be executed under the laws of the state of Tennessee. All laws that apply to this contract should come from 
the state of Tennessee, regardless of the applicant’s home state or location of their business, agent, or representation of any 
kind, if applicable.
